Dubai: Ten suspects are on trial for causing the accidental death of a worker who sustained severe head injuries when a concrete block fell on him from the fifth floor.
The Public Prosecution charged a 22-year-old Bangladeshi carpenter, four Indian workers, aged 22 to 35, and five Egyptians including three civil engineers, a worker and a clerk, with failing to carry out their job properly which led to the death of 29-year-old Indian worker, D.M.
Lawyer Eisa Bin Haidar, of Eisa Bin Haidar Group of Advocates and Legal Consultants, who is defending the five Egyptian suspects told the Dubai Court of Misdemeanours said, "My clients are innocent. The deceased was responsible for his own death. Despite the fact that he was repeatedly warned against standing or passing under the crane which was carrying concrete blocks, he violated the instructions."
He added, "When he walked underneath the crane, the concrete block accidentally fell on his head from the fifth floor and killed him. One of the suspects testified that the victim and his colleagues were warned against walking under the crane for their own safety."
Bin Haidar argued that the victim behaved bizarrely when he 'took his own risk and ... walked underneath the crane'.
Prosecution records said the suspects who pleaded innocent before the court, negligently placed the concrete blocks in an unsafe wooden box and lifted it up with a crane from the ground to the fifth floor of a building under construction.
Records added that the box didn't meet safety standards set by the Environment, Health and Safety Section at Dubai Municipality.
Police records said the victim was working in the sewerage system when the block fell and hit his head.
Paramedics rushed to rescue the victim at the accident site but he succumbed to fatal head injuries.
